MOSCOW, Jan 15 (PRIME) -- Russian iPhone users will file first lawsuits against Apple for an intentional slowing of its older smartphones during the coming days, business daily Kommersant reported on Monday, quoting law firms NLF Group managing partner Maxim Karpov and Lex Borealis partner Dmitry Ponomaryov.
A total claimed amount will be “several tens of millions of rubles,” the lawyers said.
NLF Group finances court expenses of plaintiffs in exchange for a share in the compensation that could be granted by the court, and Lex Borealis provides legal support. “Usually, a legal investor enters a case when the amount of a potential compensation exceeds the amount of expenses by 10 times. We have a first pool of plaintiffs, about 10 people, and in case of a successful legal precedent, we’ll easily raise their number to several hundreds,” Karpov said.
Under the law, slowing down of work of the iPhones can be understood as a disadvantage of goods. If it is not voiced by the seller, the consumer can ask for a replacement, a decrease in price, or an immediate free elimination of the disadvantage.
Apple was reported in late December 2017 to intentionally slow down work of the iPhone of older generations. Similar multiple lawsuits have already been filed against Apple in France, Israel, and the U.S.
